Diddy's legal team is painting this as a consensual encounter gone wrong, framing any restraint as an allegedly lawful citizen's arrest β but they're fighting an uphill battle against an active criminal investigation.
Sources close to the situation say Hay has been cooperating with investigators for months, and the Special Victims Unit taking this seriously is a major red flag for Combs. The fact that Largo PD forwarded everything to Los Angeles County Sheriff's Department means multiple agencies are watching.
Hay filed suit in July 2025 for sexual battery, intentional infliction of emotional distress, and false imprisonment. Diddy responded in April 2026 denying all allegations. Hay filed a police report in Largo, Florida in September 2025 that was forwarded to the LA County Sheriff's Department Special Victims Unit.
Diddy's legal team can spin this however they want β but when SVU gets involved, we're talking criminal territory now. Hay says charges are coming. The question is when.
Jonathan Hay isn't backing down one inch. The publicist who dropped a bombshell lawsuit against Sean "Diddy" Combs last July is hitting back hard after the embattled mogul's legal team filed their response in April, denying everything and claiming any alleged restraint was carried out as part of a citizen's arrest. Hay, speaking exclusively to TMZ, called that defense absolute fiction β and dropped what could be the most damning detail yet.
"It is perplexing that his team would file such a narrative while knowing they are under criminal investigation in California," Hay said. "There was nothing consensual about it. He forced himself on me while I was being held against my will.
I'm praying there will be criminal charges soon." The allegations are graphic and specific. Hay claims Diddy pressured him to take ketamine before masturbating in front of him at a Los Angeles warehouse filled with Biggie Smalls' clothing β one of the late rapper's most iconic archival collections. According to the lawsuit, Diddy allegedly orgasmed into one of Biggie's shirts while watching porn on his phone and even demanded Hay "finish him off" sexually.
Here's where it gets spicy for CJ Wallace, Biggie's son who's also named in the suit. Wallace filed a countersuit against Hay for defamation β and won. A default judgment was entered because Hay allegedly failed to respond to the countersuit.
But Hay tells us he was never officially served court papers. Wallace's lawyers fired back with documentation showing substitute service was completed through the Florida Secretary of State after they couldn't reach Hay at his addresses. That legal dance isn't over yet.
The criminal angle is what has everyone watching closely. In September 2025, Hay filed a police report in Largo, Florida β where he lives β detailing these exact allegations against Diddy. The Largo Police Department forwarded that report to the Los Angeles County Sheriff's Department, and we're told the Special Victims Unit is actively investigating Hay's accusations.
That's not standard protocol for dismissed claims. Diddy's team has been busy on multiple legal fronts as federal investigators continue examining his business dealings and personal conduct. The mogul is currently serving time at MDC Brooklyn after pleading guilty to two prostitution-related charges last year β a conviction that doesn't directly relate to Hay's allegations but certainly adds to the mounting legal troubles.
For now, Hay remains resolute while Diddy's camp maintains their hard-line denial. But with criminal investigators in California now involved and Hay publicly stating he expects charges "soon," this story is far from its final chapter.
